Terms of Service

1. The Service

Insta QR Menu lets restaurants and similar businesses ingest, edit and publish digital menus. Features may evolve over time. We may add, modify or remove features, with reasonable notice for material changes.

2. Accounts

• You must be at least 16 years old and able to enter into a binding contract.
• You're responsible for everything that happens under your account, including actions by anyone you let use it.
• Keep your credentials confidential. Notify us immediately of any unauthorised access.

3. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, fraudulent or infringing activity.
• Upload content that is illegal, defamatory, obscene, or violates a third party's rights.
• Reverse-engineer, scrape, or interfere with the Service's operation.
• Resell, sublicense or expose the Service to third parties as a standalone product.
• Use the Service to send spam or unsolicited messages.

4. Fees and billing

• Paid plans are billed in advance, monthly or annually, via Stripe.
• Fees are non-refundable except where required by law or expressly stated.
• We may change pricing with at least 30 days' notice; changes apply to renewals.
• If a payment fails, we may suspend paid features until the balance is settled.
• Statutory consumer rights, where they apply, are not affected.

5. Your content

You retain ownership of menus, images and other content you upload ("Your Content"). You grant us a worldwide, non-exclusive licence to host, process, transmit and display Your Content solely to operate and improve the Service.

You are responsible for ensuring you have the right to upload Your Content, that it is accurate (especially prices and allergens), and that it complies with applicable food-information laws.

6. AI-generated suggestions

The Service uses AI to extract and suggest menu information (e.g. descriptions, allergens, dietary tags). AI output may be inaccurate or incomplete. You must review and confirm all AI-generated information before publishing — especially allergen and dietary claims, which can have legal and health consequences. We are not liable for losses arising from unreviewed AI output.

7. Our intellectual property

The Service, including software, design and trademarks, is owned by us or our licensors. We grant you a limited, non-transferable, revocable licence to use the Service in accordance with these Terms.

8. Warranties and disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

Nothing in these Terms excludes liability that cannot be excluded by law (e.g. fraud, death or personal injury caused by negligence).

10. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination, your right to use the Service ends and we may delete Your Content after a reasonable retention period.

11. Changes to these Terms

We may update these Terms. Material changes will be notified by email or in-app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of not yet published — available on request. The courts of not yet published — available on request have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.
